STANDARD TERMS AND CONDITIONS 

The below text outlines Japanese Car Club UK's Terms & Conditions and client responsibility. These Terms & Conditions of Use, together with the other terms and conditions referred to herein, set out the terms of use under which you may use Japanese Car Club UK's apps, websites and/or services. 

Please read these Terms & Conditions of Use carefully and ensure that you understand them. Your agreement to comply with and be bound by these Terms & Conditions of Use is deemed to occur upon your first use and/or first account creation.

1. The Client and/or User explicitly waives its own standard terms and conditions, even if these were drawn up after these standard terms and conditions of sale. In order to be valid, any derogation must be expressly agreed to in advance in writing.
   
   
2. Access to Our Apps, Websites and/or Services is provided "as is" and on an "as available" basis. We may alter, suspend or discontinue Our Apps, Websites and/or Services (or any part of it) at any time and without notice. We will not be liable to you in any way if Our Apps, Websites and/or Services (or any part of it) is unavailable at any time and for any period.
   
   
3. Many of Our Apps, Websites and/or Services require an Account in order to access them. When creating an Account, the information you provide must be complete and accurate. It is your responsibility to ensure that all Account information is kept up-to-date at all times. 
   
   
4. All Users must be older than eighteen (18) years of age when creating an Account. You may NOT create an Account if you are under eighteen (18) years of age. If you are under eighteen (18) years of age and wish to use the parts of Our Apps, Websites and/or Services that require an Account, your parent or legal guardian should create the Account in their name and then add/submit your details as the participating rider/attendee.
   
   
5. We recommend that you always enter a strong password for your Account and enable and use 'Two-factor Authentication' whenever and wherever possible.
   You must NOT use anyone else’s Account. We will NOT be liable for any unauthorised access and/or use of your Account.
   
   
6. We offer no promise, or guarantee (whether express or implied) that User Content displayed or provided via Our Apps, Websites and/or Services is complete, accurate, or up-to-date. We are not responsible for the content or accuracy, or for any opinions, views, or values expressed in User Content. Any such opinions, views, or values are those of the relevant User and do not reflect the opinions, views, or values of Japanese Car Club UK in any way.
   
   
7. By providing / adding / submitting User Content to the Japanese Car Club UK Apps, Websites and/or Services, Users confirm that they are legally allowed to do so and that they are not infringing any statutory provisions and/or third-party rights. Users acknowledge and accept that by providing their own User Content on the Japanese Car Club UK Apps, Websites and/or Services, they grant the Japanese Car Club UK a non-exclusive, fully free and legally binding license to process such content solely for the operation and maintenance of the Japanese Car Club UK Apps, Websites and/or Services as contractually required. To the extent permitted by applicable law, Users waive any moral rights in connection with all User Content they provide to Japanese Car Club UK Apps, Websites and/or Services.
   
   Users acknowledge, accept and confirm that all User Content they provide through Japanese Car Club UK Apps, Websites and/or Services is provided subject to the same general Terms & Conditions of Use set forth for Japanese Car Club UK Apps, Websites and/or Services.
   
   
8. By purchasing a ticket through the Japanese Car Club UK Apps, Websites and/or Services, you agree to pay the specified price for the selected ticket and any applicable fees or taxes. Electronically purchased tickets will be active only after the payment is completed successfully. It is the responsibility of the ticket holder to ensure the successful completion of the payment process. Japanese Car Club UK will not be held liable for any issues arising from payment failures or payment delays. All Electronically purchased tickets are not refundable, resellable or transferable unless otherwise stated.
   All Electronically purchased tickets must be presented in a manner that allows verification of the booking code to the controller who requires ticket inspection for check-in and/or attendance.
   
   
9. To the fullest extent permissible by law, We accept no liability to any User for any loss or damage, whether foreseeable or otherwise, in contract, tort (including negligence), for breach of statutory duty, or otherwise, arising out of or in connection with the use of (or inability to use) Our Apps, Websites and/or Services or the use of or reliance upon any Content (including User Content) displayed or provided via Our Apps, Websites and/or Services.
   
   
10. We neither assume nor accept responsibility or liability arising out of any disruption or non-availability of Our Apps, Websites and/or Services resulting from external causes including, but not limited to, equipment failure, communications network failure, natural events, acts of war, or legal restrictions and censorship.
    
    
11. If you are a business user, We accept no liability for loss of profits, sales, business or revenue; loss of business opportunity, goodwill or reputation; loss of anticipated savings; business interruption; or for any indirect or consequential loss or damage.
    
    
12. Our secure online payments are payable (in full) as part the checkout process. Our invoices are payable within seven (7) business working days, unless another payment timeframe is indicated on either the invoice or the order. In the event of non-payment by the due date, Japanese Car Club UK reserves the right to request a fixed interest payment amounting to 10% of the sum remaining due if required. 
    
    
13. In the event of late payment, Japanese Car Club UK will be authorized to suspend any provision of services provided without prior warning and/or notification.
    
    
14. Japanese Car Club UK undertakes to do its best to supply performant services in due time in accordance with the agreed timeframes. However, none of its obligations can be considered as being an obligation to achieve results. Japanese Car Club UK cannot under any circumstances, be required by the client to appear as a third party in the context of any claim for damages filed against the client by an end consumer.
    
    
15. Certain countries apply withholding at source on the amount of invoices, in accordance with their internal legislation. Any withholding at source will be paid by the client to the tax authorities. Under no circumstances can Japanese Car Club UK become involved in costs related to a country's legislation. The amount of the invoice will therefore be due to Japanese Car Club UK in its entirety and does not include any costs relating to the legislation of the country in which the client is located.
    
    
16. If a payment is still outstanding more than twenty-one (21) days after the due payment date, Japanese Car Club UK reserves the right to call on the services of a debt recovery company. All legal expenses will be payable by the client.
    
    
17. Japanese Car Club UK is a CLUB and/or Trading name - referred to as either "the Company", "We", "Us" or "Our" in all/any Agreement(s).

19. In order for it to be admissible, Japanese Car Club UK must be notified of any claim by means of a letter sent by recorded delivery to its office within ten (10) business working days of the delivery of the goods or the provision of the services.
    
    
20. You must only use Our Apps, Websites and/or Services in a manner that is lawful. You must ensure that you comply fully with any and all local, national or international laws and/or regulations at all times. You must NOT use Our Apps, Websites and/or Services in any way, or for any purpose, that is unlawful or fraudulent. You must NOT use Our Apps, Websites and/or Services to knowingly send, upload, or in any other way transmit data that contains any form of virus or other malware, or any other code designed to adversely affect computer hardware, software, or data of any kind.
    
    
21. When submitting User Content (or communicating in any other way using Our Apps, Websites and/or Services) you must NOT submit, communicate or otherwise do anything that: 
    is sexually explicit, is obscene, is deliberately offensive, is hateful or otherwise inflammatory, promotes violence, 
    promotes or assists in any form of unlawful activity, is misleadingly impersonates any person or otherwise misrepresents identity or affiliation in a way that is calculated to deceive, discriminates against or is in any way defamatory of any person / group / class of persons / race / gender / religion / nationality / disability/sexual orientation/age, is intended or otherwise likely to threaten / harass / annoy / alarm / inconvenience / embarrass another person,
    is intended or otherwise likely to infringe (or threaten to infringe) another person’s right to privacy or otherwise uses their personal data in a way that you do not have a right to.
    
    
22. We reserve the right to suspend or terminate your access to Our Apps, Websites and/or Services if you (or your Account) breach any of the provisions of these Terms & Conditions of Use. Specifically, Japanese Car Club UK) may take one or more of the following actions as We deem reasonably necessary:
    Suspend, whether temporarily or permanently, your Account and/or your right to access Our Apps, Websites and/or Services.
    Remove any User Content submitted by you that violates our Terms & Conditions of Use or Acceptable Usage Policy.
    Disclose such information to law enforcement authorities as required or as We deem reasonably necessary and/or Take legal action against you as appropriate.
    Any other actions which We deem reasonably appropriate (and lawful).
    We hereby exclude any and all liability arising out of any actions (including, but not limited to those set out above) that We may take in response to breaches of these Terms of Use.
    We reserve the right to remove any User Content that breaches these terms. If we do so, All/Any Fees are non-refundable. In addition, we may also suspend or terminate your account. All sums due will remain due and payable regardless of any suspension or termination for any reason.
    
    
23. Japanese Car Club UK reserves the right to modify or update the Terms & Conditions of Use at any time without prior notice. Any changes will be effective immediately upon posting the updated Terms & Conditions of Use on Our Apps, Websites and/or Services. By continuing to use Japanese Car Club UK Apps, Websites and/or Services, you agree to be bound by the revised and/or updated Terms & Conditions of Use.
    
    
24. All our contractual relations will be governed exclusively by UK law.
